PetFamFolio Terms of Service

These Terms of Service ("Terms") govern your access to and use of PetFamFolio.com and the PetFamFolio subscription service.
By creating an account, purchasing a subscription, or using PetFamFolio, you agree to these Terms.
1. About PetFamFolio
PetFamFolio is an online subscription service designed to help pet owners create, organize, maintain, and reference information relating to their pets.
Customers may maintain information including, but not limited to, pet photographs, identification information, measurements, veterinary information, vaccinations, medications, allergies or special needs, feeding information, microchip information, emergency contacts, and other pet-related records.
PetFamFolio provides an organizational and recordkeeping service. Customers remain responsible for the information stored in their accounts.
2. Customer Accounts
Customers are responsible for providing accurate account information and maintaining the confidentiality and security of their login credentials.
Customers are responsible for activity occurring through their accounts.
Customers should immediately take appropriate steps to secure their accounts if they believe their login credentials have been compromised.
3. Customer Content
Customers retain responsibility for information, photographs, records, and other content they enter or upload to PetFamFolio.
By uploading or entering content, the customer represents that they have the right or authorization necessary to store that content through the service.
PetFamFolio does not claim ownership of customers' pet photographs, pet records, or other customer-created content merely because the information is stored through the PetFamFolio service.
4. Acceptable Use
PetFamFolio is intended for lawful pet-related recordkeeping and related personal use.
Customers may not use PetFamFolio to upload, store, publish, transmit, or maintain:

Pornographic or sexually explicit photographs, images, videos, text, or other material;

Illegal content;
-
Content that exploits or sexually depicts minors;

Content that violates another person's intellectual-property rights;

Malicious software, viruses, or other harmful computer code;

Content intended to facilitate fraud or unlawful activity;
-
Content that unlawfully violates another person's privacy; or
-
Other content prohibited by applicable law or applicable Wix policies.
These restrictions apply even when a customer's account, pet profile, page, or other content is designated private or is not publicly accessible.
A private account does not create an exception to these acceptable-use requirements.
5. Pet and Veterinary Information
PetFamFolio provides customers with a place to organize information for their own reference.
PetFamFolio is not a veterinary practice and does not provide veterinary diagnosis, treatment, medical advice, or emergency veterinary services.
Information stored in PetFamFolio should not replace professional veterinary records or advice from a licensed veterinarian.
Customers should contact an appropriate veterinarian or emergency veterinary provider when their pet requires medical attention.
6. Customer Responsibility for Information
Customers are responsible for ensuring that information stored in their accounts is accurate, complete, current, and appropriate for their intended use.
PetFamFolio does not guarantee the accuracy of information entered by customers.
Customers are responsible for maintaining any independent copies of records they consider important.
7. Subscription and Payment
Access to PetFamFolio requires a paid subscription. The current monthly subscription price is $7.00 and is billed on a recurring basis through Wix Checkout.
By purchasing a recurring subscription, the customer authorizes the applicable recurring charge until the subscription is canceled.
Customers may cancel at any time. Cancellation prevents the $7.00 subscription from being charged in the next billing cycle.
Recurring payments that have already been processed are non-refundable, except where a refund is required by applicable law.
Customers may cancel to stop use, cancel to pause their use of PetFamFolio, or cancel and delete their profile at their discretion.
Customers are responsible for maintaining valid payment information associated with their subscription.
8. Taxes
Customers may be charged applicable sales, use, or similar taxes when required by law.
PetFamFolio may use transaction and customer-location information to determine whether PetFamFolio has tax registration, collection, reporting, or remittance obligations in a particular jurisdiction.
Tax treatment may change as PetFamFolio's customer activity, applicable laws, or tax obligations change.
9. Cancellation
Customers may cancel their PetFamFolio subscription at any time using the cancellation options made available through PetFamFolio or its Wix-powered account and subscription features.
Cancellation stops future renewal charges beginning with the next billing cycle. Cancellation does not refund or partially refund a recurring payment that has already been processed, except where required by applicable law.
Deleting information from a pet profile is not necessarily the same as canceling a paid subscription. Customers who want to stop future recurring charges should make sure their subscription is canceled.
10. Customer Deletion of Information
Customers are responsible for managing and deleting information stored within their accounts using the features provided through the website.
Deleting information from a pet profile does not necessarily require deletion of transaction, subscription, accounting, tax, fraud-prevention, security, or other records that PetFamFolio or Wix may be required or permitted to retain.
11. Privacy
PetFamFolio's handling of customer information is described in the PetFamFolio Privacy Policy.
PetFamFolio does not sell or rent customers' personal information and does not use private pet-profile content for advertising or marketing.
PetFamFolio operates through the Wix platform. Wix and applicable service providers may process information as necessary to provide hosting, member accounts, subscriptions, checkout, payment processing, security, and related services.
12. Suspension or Termination
PetFamFolio may restrict, suspend, or terminate access to the service when reasonably necessary because of:

A material violation of these Terms;

Illegal activity;

Fraudulent activity;

Prohibited content;

Misuse of the website or service;

Security threats;
-
Failure to maintain an applicable paid subscription; or
-
Requirements imposed by applicable law, Wix, payment processors, or other service providers necessary to operate PetFamFolio.
When appropriate and legally permissible, PetFamFolio may provide the customer with an opportunity to correct a violation before terminating an account.
13. Availability of the Service
PetFamFolio relies on Internet services and third-party technology, including the Wix platform.
PetFamFolio cannot guarantee that the website will operate continuously or without interruptions, errors, maintenance periods, outages, or technical problems.
Customers should maintain independent copies of particularly important pet, veterinary, medication, vaccination, microchip, and emergency information.
14. No Emergency-Service Guarantee
PetFamFolio should not be relied upon as the sole location for information needed during a medical or other emergency.
Customers are encouraged to maintain appropriate backup copies of important pet records and emergency contact information.
15. Intellectual Property
The PetFamFolio name, branding, website design, original text, graphics, logos, and other materials created by or for PetFamFolio may be protected by applicable intellectual-property laws.
Customers may not copy, reproduce, distribute, or commercially exploit PetFamFolio's protected materials without authorization, except as permitted by applicable law.
Customer-created content remains subject to the customer-content provisions of these Terms.
16. Changes to the Service or Terms
PetFamFolio may modify its services, features, subscription offerings, or these Terms from time to time.
When these Terms are materially updated, PetFamFolio will post the revised Terms with an updated effective date and provide any additional notice required by applicable law.
Continued use of the service following an effective change constitutes acceptance to the extent permitted by applicable law.
17. Governing Law
These Terms will be governed by applicable United States law and the laws of the state in which PetFamFolio is legally established or operates, without overriding any consumer protections that cannot legally be waived.
